We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our services for lawful purposes only. Any misuse, redistribution, or modification of our services is prohibited and may result in immediate termination.


5. Prohibited Conduct


You agree not to:

– Use the services for any illegal, harmful, or fraudulent activity.
– Interfere with the integrity or performance of our platform.
– Attempt unauthorized access to our systems or networks.
– Transmit viruses or other harmful content.
– Misrepresent your identity or affiliation with any entity.


6. Fees, Payment, and Refunds


All fees are due in U.S. dollars and are subject to any applicable taxes. By providing payment information, you represent and warrant that you have the legal right to use the payment method. Refunds are governed by our refund policy, which is available upon request.


7. Intellectual Property Rights


All content, trademarks, and intellectual property rights on our platform are the exclusive property of Hulu Truck Dealers or its licensors. Unauthorized use, reproduction, or distribution of any content is strictly prohibited.


8. Data Privacy

10. Disclaimer of Warranties

11. Limitation of Liability


To the fullest extent permitted by law, we shall not be liable for any damages, including but not limited to indirect, incidental, punitive, or consequential damages arising out of your use of our services.


12. Indemnification


You agree to indemnify, defend, and hold Hulu Truck Dealers harmless from any claims, losses, damages, liabilities, costs, or expenses arising from your use of our services or your violation of this Agreement.


13. No Waiver


Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or of the right to enforce it in the future. Any waiver must be in writing and signed by an authorized representative.


14. Severability


If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the extent necessary to make it enforceable while reflecting the intent of the original provision.


15. Entire Agreement


This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Hulu Truck Dealers regarding your use of our services. Any prior agreements, representations, or understandings, whether written or oral, are superseded by this Agreement.


16. Governing Law and Jurisdiction


This Agreement is governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts in Georgia.


17. Changes to This Agreement


We reserve the right to modify or amend this Agreement at any time. The latest version will be posted on our website, and by continuing to use our services, you agree to be bound by the revised terms.

User Responsibilities and Code of Conduct


As a user of our platform, you are expected to adhere to a high standard of professionalism and ethical conduct. You agree to use our services responsibly, respecting the rights and privacy of others. Misuse of our services, including but not limited to spamming, harassment, abuse, or any activity that interferes with the experience of other users, is strictly prohibited. Violations of this code may lead to the suspension or termination of your account and potential legal action. By upholding these responsibilities, you contribute to a positive and secure environment for all users.


Protective Terms for Truck Usage, P2P Transactions, Shipments, and Offline Interactions


The following Protective Terms apply to all activities facilitated by Hulu Truck Dealers, including but not limited to truck rentals, purchases, peer-to-peer (P2P) transactions, shipment coordination, insurance coverage, compliance with governmental and regulatory bodies, and all offline interactions. By using our services, you acknowledge and agree to abide by these Protective Terms to ensure safe and compliant transactions.

 

1. Truck Use and Operational Responsibilities


All users are required to operate vehicles obtained through our platform in strict compliance with applicable local, state, and federal laws, including the Federal Motor Carrier Safety Administration (FMCSA) and Department of Transportation (DOT) regulations. You must hold a valid driver’s license, maintain adequate insurance coverage as required by law, and ensure that any vehicle rented or purchased through our platform is operated only by qualified personnel.

 

Users assume full responsibility for any damages, maintenance issues, operational costs, and repairs arising during the rental or ownership period. Hulu Truck Dealers is not liable for damages, injuries, or losses resulting from misuse, improper handling, or neglect of vehicles, including but not limited to failure to follow operational instructions, overloading, or unauthorized modifications. Users must report any incidents involving the vehicle, including accidents or violations, to local authorities and Hulu Truck Dealers within 24 hours.

 

2. Insurance Coverage and Liability


While Hulu Truck Dealers may facilitate access to third-party insurance options, users are ultimately responsible for securing adequate insurance coverage for rentals or purchased vehicles, including liability, collision, and comprehensive coverage. Hulu Truck Dealers does not provide insurance or assume responsibility for any insurance claims, disputes, or coverage limitations between users and third-party insurers.

 

In the event of damage, theft, or loss involving rented or purchased vehicles, it is the user’s responsibility to work directly with their insurance provider to process claims. Hulu Truck Dealers shall not be liable for uninsured damages or losses, nor for any deficiencies in coverage under the user’s insurance policy. Users are advised to review insurance policies carefully, including terms for deductibles, exclusions, and claim procedures, prior to renting or purchasing a vehicle.

 

3. Peer-to-Peer (P2P) Interactions and Responsibilities


Hulu Truck Dealers provides a platform to facilitate P2P transactions, allowing users to rent, buy, or sell trucks directly with one another. All users engaging in P2P transactions are responsible for conducting due diligence and ensuring compliance with applicable laws, regulations, and industry standards. Hulu Truck Dealers does not mediate disputes or assume liability for issues arising from P2P transactions, including but not limited to payment disputes, vehicle condition, or misrepresentation by either party.

 

Users engaging in P2P transactions are encouraged to obtain independent inspections, confirm ownership documentation, and request verification of insurance coverage. Any contractual agreements made between users in a P2P transaction are the responsibility of the parties involved, and Hulu Truck Dealers shall not be liable for any breach, fraud, or misrepresentation committed by either party. Users agree to hold Hulu Truck Dealers harmless from all claims arising from their participation in P2P transactions.

 

4. Shipment and Delivery Terms


For shipments arranged through Hulu Truck Dealers, third-party logistics providers are typically engaged to handle transportation, and users must comply with all applicable shipping terms, conditions, and guidelines. While Hulu Truck Dealers seeks to work with reputable carriers, we do not assume liability for any damages, delays, or losses incurred during shipment, including but not limited to incidents caused by mishandling, accidents, natural disasters, or delays in transit.

 

Users are advised to review and agree to the terms and conditions of the third-party carrier responsible for shipping, and to verify that adequate insurance coverage is in place. In the event of shipment-related issues, users must address claims directly with the carrier or insurer, as Hulu Truck Dealers does not process or guarantee compensation for lost or damaged shipments. Users acknowledge that shipment timelines provided by carriers are estimates and are not guaranteed by Hulu Truck Dealers.

 

5. Compliance with Government Regulations and Certifications


Users are responsible for ensuring that all trucks rented or purchased through Hulu Truck Dealers comply with applicable government regulations, including but not limited to FMCSA, DOT, Environmental Protection Agency (EPA), and local licensing requirements. Hulu Truck Dealers provides general information on regulatory standards, but users are required to verify compliance for their specific use cases.

 

Vehicles intended for interstate transport must meet FMCSA and DOT standards, and users must complete all necessary inspections and certifications before operating on public roadways. Hulu Truck Dealers is not liable for fines, penalties, or legal actions resulting from non-compliance with regulatory requirements, and users assume all risks associated with regulatory violations.

 

6. Incident Reporting and Risk Management


In the event of an accident, theft, mechanical breakdown, or other incident involving a rented or purchased vehicle, users must immediately report the incident to Hulu Truck Dealers, local authorities, and their insurance provider. Users are responsible for covering all costs associated with the incident, including but not limited to repairs, legal fees, towing, and storage. Hulu Truck Dealers may offer support in coordinating repairs or assessments, but we do not assume liability for incident-related expenses.

 

All incidents must be reported within 24 hours. Failure to report an incident promptly may result in suspension of access to Hulu Truck Dealers services and potential legal consequences. Users acknowledge that they assume all risks related to vehicle use, including risks of personal injury, property damage, and financial loss.

 

7. Liability Limitation and Assumption of Risk


By engaging in offline interactions, including truck rentals, purchases, P2P transactions, and shipments, users acknowledge and assume all associated risks. Hulu Truck Dealers expressly disclaims liability for any direct, indirect, incidental, punitive, or consequential damages arising from offline activities, including but not limited to personal injury, property damage, or financial losses. Users agree to release and hold harmless Hulu Truck Dealers from any claims, losses, or damages resulting from their offline interactions.

 

8. Indemnification


Users agree to indemnify, defend, and hold harmless Hulu Truck Dealers, its affiliates, officers, directors, employees, and agents from any claims, liabilities, losses, damages, and expenses (including attorneys’ fees) arising from or related to their offline activities, including but not limited to truck use, P2P transactions, shipment issues, regulatory compliance, and incident management.

 

These Protective Terms are intended to provide a comprehensive outline of user responsibilities and limitations of liability in all offline interactions facilitated by Hulu Truck Dealers. By using our services, you acknowledge that you have read, understood, and agreed to these terms.

By engaging in any transactions, operations, or offline interactions facilitated through Hulu Truck Dealers, you acknowledge that you have read, understood, and agreed to the Protective Terms set forth above. You assume all associated risks and responsibilities, including those related to legal compliance, financial liability, and personal safety. Hulu Truck Dealers provides a platform to connect users and facilitate transactions but does not endorse, guarantee, or assume liability for the actions, reliability, or integrity of other parties involved. Your use of our platform constitutes an agreement to hold Hulu Truck Dealers harmless from any and all claims, losses, or damages arising from your engagement in offline activities, including P2P transactions, truck usage, or third-party logistics. We strongly encourage users to exercise due diligence, seek legal counsel when necessary, and make informed decisions in all interactions.
